Ziele, Inhalte und Methode der Lehrveranstaltung
The course aims to teach students the ability to independently analyze legal problems in an academic manner and to present the results of such analysis. The course covers legal problems that have emerged in case law and legal literature or that stem from recent legislative reforms. It focuses on international dispute resolution, for instance issues emerging from recent case law in arbitration, cross-border enforcement of judgements, cross-border taking of evidence and so forth. Potential topics will be further defined in the course of the first meeting. Students may also submit suggestions for topics.
Art der Leistungskontrolle und erlaubte Hilfsmittel
The first session, taking place on 8 March 2017, is dedicated to the selection and distribution of topics. Following the first session, undergraduate students will have to independently research case law and literature concerning their topic and draft a research paper. The research paper’s results will then be presented in the course of a two days session scheduled for 31 May 2017 to 1 June 2017. Each presentation will be followed by a discussion. Graduate students do not have to submit a research paper. They will only have to present the result of their research during the sessions indicated.
Mindestanforderungen und Beurteilungsmaßstab
To pass the course graduate students are required to submit a research paper in accordance with the principles of good scientific practice and the quality criteria laid down in section 22 of the curriculum for undergraduate studies of law at the University of Vienna. Each performance, i.e. research paper and presentation, will be assed individually. The research paper determines 70 percent and the presentation 30 percent of the final assessment (grade). Graduate students will be assessed on the basis of their presentation only.Mandatory Participation:
